EMERGING TECHNOLOGIES IN THE JUDICIAL SYSTEM

Technology plays a significant role in all aspects of court proceedings, and this need has become ever more evident as courts have shifted to conducting business electronically and virtually. Some notable emerging technologies are listed below.

  1. Court Processes Going Digital

One of the standout advantages of emerging technologies is the digitization of court proceedings. The adoption of electronic systems can lead to a decrease in paperwork, enhance accessibility, and streamline case management. The transformation of court records into digital formats can significantly enhance their accessibility, bolster transparency, and accelerate the judicial process. For instance, the e-Courts project in India strives to computerise court operations in the nation, ultimately enhancing the efficiency of the judicial system.

  • Use of Artificial Intelligence and Machine Learning

Artificial Intelligence (AI) and Machine Learning (ML) are playing a pivotal role in transforming the legal sector. These technologies have the ability to sift through vast amounts of data, identify correlations and make predictions based on this, making them an invaluable tool for legal research. For example, platforms like ROSS Intelligence and Luminance use AI algorithms to perform complex legal research tasks, saving lawyers time and effort.

  • E-filing of Cases

Utilizing e-filing method can expedite the case filing process, increase efficiency and reduce costs along with improving data accuracy and eliminating the need for physical court appearances.  For instance, the Supreme Court of India’s e-filing portal empowers lawyers and litigants to electronically submit cases and retrieve case records over the internet.

  • Video Conferencing for Hearings

The use of video conferencing facilitates remote conduct making it easier for lawyers and litigants to participate in the judicial process. Video conferencing streamlines time and cost savings, lessens the travel-related burdens, and guarantees the safety and security of all participants.

  • Blockchains for Secure Record-keeping

Blockchain technology holds the promise of transforming the management of legal contracts and documents by offering a secure and transparent digital environment for information storage and sharing. For example, smart contracts, which independently enforce contract terms and conditions, have the potential to manage transactions and agreements, thus reducing the reliance on third-party intermediaries and mitigating the potential for fraudulent activities. Furthermore, blockchain technology can be helpful to preserve and verify important documents like property deeds or wills, which may greatly simplify the process of proving ownership and resolving disputes relating to these documents. For example, the Indian state of Telangana has adopted blockchain technology to safeguard land records and prevent fraudulent activities.

USE OF TECHNOLOGY IN INDIAN COURTROOM

Technology has begun to play an increasingly vital role in Indian courtrooms, modernising the legal system and improving the administration of justice. The Indian judicial system was earlier not that well-versed with the use of technology, however the pandemic compelled India to embrace technology that had been previously overlooked. Since then, the Supreme Court of India and the Ministry of Law and Justice have taken several measures to keep the courtroom proceedings and other related activities easy and effortless for litigants and judicial officers using various modern technologies. Given the proactive adoption of technology by Indian courts, it is indisputable that the effective utilisation of technology is not a distant possibility; it is firmly established and here to stay. Some of the major successful technological developments in the Indian courts are listed below.

  1. e-Courts Project

The “e-Courts Project” is a notable initiative implemented by the Supreme Court of India. It was conceptualised with a vision to transform the Indian Judiciary by ICT (Information and Communication Technology) enablement of Courts. This nationwide initiative is overseen and financed by the Department of Justice, under the Ministry of Law and Justice, aimed at supporting District Courts throughout India. This project seeks to modernise and digitise the Indian court system to enhance efficiency and accessibility. It involves the computerization of courts, digital case management, and the creation of the National Judicial Data Grid (NJDG), providing online access to case information, judgments, and case status. The E-Courts Project aims to streamline judicial processes, reduce paperwork, and make legal services more accessible to the citizens of India. It represents a significant step towards leveraging technology for the improvement of the Indian legal system. As part of eCourts project, 7 platforms have been created to provide real time information on case status, cause lists, judgements etc. to lawyers/Litigants through SMS Push and Pull (2,00,000 SMS sent daily), Email (2,50,000 sent daily), multilingual and tactile e-Courts services Portal (35 lakh hits daily), JSC (Judicial Service centres) and Info Kiosks[1].

  • SUVAS

To promote regional languages in the judicial procedure, the Supreme Court of India has developed SUVAS – Supreme Court Vidhik Anuvaad Software which is a machine assisted translation tool trained by AI. This tool is specially designed for judicial domain and currently has the capacity to translating Indian judicial documents, orders or judgements into 10 vernacular languages – Hindi, Kannada, Tamil, Telugu, Punjabi, Marathi, Gujarati, Malayalam, Bengali, Urdu and vice-versa. This is a landmark initiative to increase access to justice[2].

  • SUPACE

A project started under the guidance of former Chief Justice of India S. A. Bobde, the Supreme Court Portal for Assistance in Court’s Efficiency (SUPACE) is a tool designed to gather pertinent facts and laws and providing them for the judge’s reference. SUPACE was designed to first understand judicial processes that require automation, it then assists the Court in improving efficiency and reducing pendency by encapsulating judicial processes that have the capability of being automated through AI.

  • JustIS App

JustIS Mobile App is developed for the Judges of District & Subordinate Courts in the country. The App is username/password protected. The App is a digital repository that provides all details about his/her court at the handset 24×7[3].

Other than these major developments, there are many sub-projects that are being tested and carried out in the Indian courtrooms. Hearings held on videoconferencing, use of Wi-Fi in court complexes, e-Filing of cases, etc have gained popularity and helped in making the courtroom proceedings accessible and hassle-free.

CHALLENGES IN THE USE OF TECHNOLOGY IN COURTROOM

  1. Data Security

It is imperative that the judicial system protects the increasingly sensitive data being stored. Any breach could threaten the integrity of the justice system and undermine public confidence.

  1. Bias and Discrimination

Emerging technologies like AI may unintentionally perpetuate bias and discrimination if not carefully designed. There is a danger that these technologies might aggravate existing biases and inequalities within the justice system.

  1. Lack of Understanding

Many legal professionals may lack the technical expertise required to fully grasp the pros and cons of emerging technologies. This knowledge gap can lead to misconceptions about how these technologies should be applied, potentially resulting in ineffective or inappropriate use.

  1. Privacy Concerns

Implementation of emerging technologies may violate the privacy rights of individuals. Technology like facial recognition could be used to identify individuals without their consent, with the potential for misuse by law enforcement or other entities.

  1. Cost

The adoption of emerging technologies can be financially burdensome, and the judicial system might lack the resources needed for these investments. This could limit the potential benefits these technologies offer to the justice system.

  1. Ethical Considerations

Implementing emerging technologies in the judicial system requires careful consideration of ethical issues. There is concern regarding the lack of the human element or ‘conscience’ necessary for the act of judging. It is crucial to ensure that these technologies do not compromise people’s rights or undermine the integrity of the justice system.

CONCLUSION

The incorporation of technology in justice delivery is continuously evolving, offering opportunities to enhance efficiency, reduce costs, improve access to justice, and modernise an often traditionally paper-heavy and bureaucratic system. However, it also raises important issues around data privacy, security, and ethical considerations, which must be carefully addressed to maintain the integrity of the justice system.

There is no doubt that emerging technology is transforming the legal profession and the administration of justice. Although challenging, integrating Information and Communication Technology (ICT) into courtrooms can enhance the efficiency and effectiveness of judicial operations. It is the responsibility of legal professionals to embrace these technologies while minimizing their potential risks, all with the ultimate goal of better serving our clients and society at large. Therefore, technology plays a significant role in all aspects of court proceedings and it is a development that will persist in the future and revolutionise the working of courtrooms and the justice delivery system for better.
